Customary Law Overview (2004)

Written in 2004, this report by Justice Aleu Akechak Jok, LLB, Robert A Leitch, M.BE and Carrie Vandewint, B.Hum M.A. is a review of Customary Law in contemporary southern Sudan. Its purpose is to examine the history of customary law and the principal customary legal systems currently in use in the region. It also studies how the various customary law systems function, the strengths and weaknesses of customary law and areas where conflict, actual or potential, exists between the different systems, domestic statutory and international law, particularly with regard to human rights. Finally, it considers options available to assist in the capacity building of southern Sudanese legal institutions in respect to customary law in the future.
